Kinetic Personnel Group is currently recruiting for an Associate Counsel for a government public agency company (government entity). This position will be based in the Ontario area. This 5 billion-dollar a year government entity is renowned for its work in the community and being a great place to work.

Provide legal research and counsel as directed by the Director of Legal Affairs in support of company’s legal department with a practice area focus on regulatory and licensing affairs.

Job duties:

· Provide legal advice to the organization, prepare resolutions and forms and participate in major legal action.

· Recommend appropriate legal strategies and courses of action to meet company’s needs.

· Provide strategic advice and counsel on the legal impact of new or proposed local, state, federal or managed care legislation or changes in government agency requirements or processes that impact company in the administration of its programs.

· Advise on legal issues dealing with the health plan’s DHCS contract and Knox-Keene obligations. Communicate with the Department of Managed Health Care (DMHC) in regard to seeking approval of regulatory filings and responses to surveys.

· Provide input and guidance to the compliance department to ensure that there is proper communication and training to staff on compliance and public law requirements.

· Handle cross-disciplinary legal matters in collaboration with regulatory and business attorneys and other professionals and paraprofessionals.

· Work collaboratively with a broad range of staff, developing and maintaining strong relationships between the legal department and other business units.

· Conduct thorough legal research and prepare executive briefings on legal issues.

· Litigation management and oversight, including regular correspondence and strategizing with outside counsel, communication with internal departments, and coordination of discovery efforts; research and analysis on various legal issues including: employment law, leave laws (FMLA, ADA, etc.), review and respond to subpoenas, Government Tort Claims and Public Records Act; and assist the Legal department in a wide variety of matters.

Requirements:

· Juris Doctorate from an accredited institution required.

· Must have an active, unrestricted, and unencumbered license to practice law in California.

· Must be an active member, in good standing, with the State Bar of California.

· A minimum of three to five (3-5) years combined experience in a law firm, corporate, or government setting.

· Federal (CMS) and State agency (DHCS, DMHC) experience highly preferred. Health care law, health plan, hospital operations experience is a plus.

· Must have strong understanding of regulatory requirements for a public agency in the delivery of health care services. Understanding and grasp of Knox-Keene Health Care Service Plan Act of 1975. Knowledge of federal Medicaid and Medicare rules and regulations. Strong knowledge of the managed care industry and policy issues impacting
