The Washington State Attorney General's Office’s
Transportation and Public Construction Divisio n (TPC) has a brand new position available for an attorney interested in handling litigation and significant client advice to the Washington State Department of Transportation (WSDOT). As this is a new position on the litigation team, TPC will tailor the right person’s case assignments and initial training to suit their interests, skills, and background. This position will be located in Spokane, WA or Tumwater, WA depending on the needs and interest of the person hired to fill this role.

This is an opportunity to join a fast-growing team handling litigation supporting some of the biggest projects in Washington State, including the replacement of the SR 520 Bridge, and the Interstate Bridge between Portland and Vancouver. In addition, our team advises WSDOT on compliance with the federal Culverts injunction in order to promote fish passage migration, and civil rights issues involving unsheltered persons on WSDOT property, among many other issues.

We are looking for someone with a passion for public service, a team-player attitude, and the intellectual curiosity and willingness to learn new and evolving subject matter areas.

Duties

In this position you will dive into complex questions involving constitutional and statutory law, including the State’s right to take private property for a public use; sovereign immunity, compliance with federal transportation laws, environmental justice, and much more.

TPC is a collegial team of outstanding legal professionals located in Tumwater. TPC provides litigation representation and advice to WSDOT in support of its construction, operation, and maintenance of state highways, the state ferry systems, and state-owned rail lines. We litigate in state and federal courts and administrative forums and offer a fast-paced and intellectually demanding legal practice while fostering a friendly and professional atmosphere. TPC considers internal training and mentoring a high priority, and maintains a respect for a healthy work-life balance. This position is approved to provide for some telework days as well as a flexible work schedule.

Typical duties performed by attorneys on the TPC litigation team include:
  • Handling all phases of litigation on behalf of WSDOT, including preparation of pleadings, discovery, alternative dispute resolution (ADR), trial, and appeals;
  • Working positively within a team setting to develop effective legal strategies;
  • Providing options-based legal advice to clients and AGO management;
  • Researching and analyzing relevant law;
  • Developing creative legal strategies and presenting them to clients.
This full-time position will be located in Spokane, WA or Tumwater, WA, and involves occasional travel, depending on client assignments and hearing locations.

Qualifications

In addition to meeting the requirements to serve as an Assistant Attorney General, the preferred candidate for this complex and rewarding work will have:

  • A minimum of three years of litigation experience at the state or federal level;
  • Excellent analytical, writing and oral advocacy skills;
  • A comfort and willingness to handle high profile, fast-paced, and challenging advice matters and cases;
  • The ability to promote a cooperative work environment that supports diversity at all levels; and
  • The ability to work effectively both independently and collaboratively with clients and co-workers.
Experience with environmental law, real property, land use, tribal law, and the Public Records Act is a plus, but not required. TPC is committed to training the right candidate in relevant subject matter areas.

Applicants must have graduated from a law school accredited by the ABA or completed the WSBA's Rule 6 Law Clerk Program; and be licensed to practice law in Washington State. (Applicants who meet the other stated qualifications and are actively pursuing admission will also be considered.) AAG salaries are set between $71,652 and $134,208. The exact amount is set in accordance with Appendix B of the AWAAG CB A.
