ASSISTANT GENERAL COUNSEL, TRADEMARKS, AMERICAS
LEGAL DEPARTMENT – NEW YORK, NY
COTY is looking for an experienced and business minded trademark lawyer to support the Coty beauty brands based in North America including iconic brands such as Calvin Klein, Marc Jacobs, philosophy, Covergirl, Sally Hansen, Tiffany, and Kylie Jenner.
At least 6 years of experience in connection with trademark law, including trademark litigation, global trademark clearance, designs, domains, and drafting contracts relevant to a practice in the intellectual property arena, with specific expertise on U.S. clearance, prosecution, and enforcement actions. Should also have general knowledge of trademark systems and processes in Europe and other key commercial areas. Experience with FTC/NAD claims substantiation issues is preferred but not required.
Requires leadership skills to manage and support junior lawyers, paralegals, and support staff.
Position is based in NY. Should have at least three years’ experience with a well-regarded law firm trademark practice coupled with at least three years of experience in an in-house role.
Project management skills are critical as this role includes oversight of complex assignment recordation projects, cross-divisional renewals, portfolio audits and budget preparation, as well as acting as a contact for external vendors charged with outsourced IP work (e.g., renewals, assignments, docketing).
This is a highly visible role within Coty that demands sound judgment, strategic insight and the ability to seamlessly handle significant demands in a fast-paced environment. Well-developed ability to understand and explain risks including analysis, mitigation opportunities and strategic options.
Experience in the consumer products area is a must.
THE ROLE
In this role you will be responsible for:
Work with internal clients to address IP needs of the company
Manage strategy, budget, and take responsibility for IP litigation impacting Coty’s brands in the Americas
Support licensed activities and interact with licensors as necessary. Be a key partner to Coty licensors
Provide legal support to marketing teams for new product launches at a worldwide level: trademark clearances, risk assessments, negotiations with owners of prior rights to secure trademarks
Manage the trademark prosecution process, and trademark maintenance deadlines
Conduct initial investigations into possible infringements and enforce company IP rights as necessary, handle incoming IP demands as they rise
Draft and respond to cease and desist letters and negotiate successful outcomes for the business
Provide US legal advice to cross-divisional IP team based in Europe as needed and manage US prosecution matters for the company.
Conduct legal review of marketing and advertising materials
Provide training and support on legal issues and developments to business teams
Manage intake and onboarding of acquired IP portfolios
Manage outside counsel as necessary
